European Studies : Europeanization

I've got to leave behind first the maqasid shariah but I wish to continue it once I am done with few assignments. Man!!! I hate assignments but that is the requirement for the course. I am going to talk about Europeanization. 

Introduction

Europeanization refers to few phenomena related to Europe and patterns of change :

I. The process in which a notionally non-European subject (be it a culture, a language, a city or a nation) adopts a number of European features.

II. Outside of the social sciences, it refers to the growth of a European continental identity or polity over and above national identities and polities of the continent.

III. It refers to the process through which EU political and economic dynamics become part of the organizational logic of national politics and policy-making.

Definitions

Europeanization has been generally referred as "being more European like." Specifically than this, it has been defined in many ways. 

Earliest conceptualization of this term was made by Ladrech (1994, 69). He defines Europeanization simply as an incremental process of reorienting the shape and direction of politics to the extent that European Community (EC) political and economic dynamics become part of organizational logic of national politics and policy making. 

It emphasizes what is known as the 'top-down approach' to Europeanization with change emanating from the impact of the Union onto the national policy. The state is viewed as reactive towards changes in the Union.

Another definition that needs to be taken into acoount is of Radaelli. He describes that Europeanization is : "A process involving a) construction b) diffusion c) institutionalization of formal and informal rules, procedures, policy paradigms, styles, 'ways of doing things' and shared beliefs and norms which are first defined and consolidated in the EU policy process. Then, they are incorporated in the logic of domestic (national or sub-national) discourse, political structures and public choices."

From a "bottom-up" approach, Europeanization occurs when states begin to affect the policy of the EU in a given area.

A more nuanced analysis posts that the institutional interaction of policy actors at the various levels of European governance leads to the redefinition of national, regional and other identities within a European context where the multiple levels of governance in Europe are not seen as necessarily in opposition to one another

An elected representative can, for example, see his loyalties and responsibilities as lying with Barcelona, Catalonia, Spain and Europe or with Amsterdam, Netherlands and Europe, for unitary states. Some scholars for example Samuel Huntington argue that citizens of European states increasingly identify themselves as such, rather than Portuguese, British, German, French, Italian and etc. 

An obvious area of change is in the institutions of Europe; the enlargement of the EU and the gradual acquisition of authority over the national member governments in numerous areas is creating a centralized European polity. The Economic and Monetary Union of the EU would be an example for this. In this case, the nations using the Euro have passed control of their monetary policy to the European Central Bank.

Another perspective of Europeanization is the "horizontal approach." This approach takes into account the transfer of politics, policies and policy making between member states of the EU. The transfer is based on a form of a "soft law" therefore is not enforceable, but is based on "best practice" and mutual recognition.

Whether Europeanization is a continuing process that will eventually lead to a full European government or whether centralization will be unable to overcome persisting national identities or increasing interests in localism is a matter of debate.

Maqasid Shariah : The Objective of Shariah

Assalaamu'alaikum wa rahmatullah


A very good and blessed Friday. We recite salawat to our beloved and noble prophet Muhammad s.a.w, the messenger and the servant of the God. Friday sermon delivered by Ustad Zayd Zahari in Islamic Center today is quite interesting. Besides I love to listen to Ustad Zayd Quranic recitation. I wanted to talk with him but I don't know, I feel shy. Macam budak-budak pulak, hahaha...

He talked about this matter called as maqasid shar'iyyah. I have no time to email to ustad Zayd but I wish to have a copy of the sermon that he delivered. It is very good in order to clarify what is shariah to some brick-head people who just lazy to read books about Islam written by a believer Muslim. Of course a believer Muslim is a Muslim who understand his religion and not because he follow anyone like his dad, his mum, his elders and people around. I don't care about non-Muslim view about this but first we Muslim ourselves must be clear on what is actually shariah? When we talk about shariah, we have this image in our mind about punishment to people or crime and some people would take this as something which could be attacked sesuka hati tuk nyang depa! I would write anything that I could still remember. My head is now so full, mannnnn!

My Opinion Before We Begin

Islam is a message of the God to the universe and it actually had began since the time of sage Adam a.s was taught with nouns. Who is sage Adam a.s? He is the forefather of all human-being who possess mind, emotion, feeling and being granted with civilization. So, human religion does not begin since Moses a.s or Jesus a.s or Muhammad s.a.w. I sometimes feel weird when looking at some non-Muslims' way of thinking, I don't know whether they are Christians or not but because we don't simply judge people by their religion but they keep talking in inconsistencies. I believe these kind of people are Western Protestant Christian pastors. I don't even hate any Jew or Christian and I found that many Western Christians especially those rednecks living in farms are quite hater to others and ignorant! I made friend with other Asian Christians especially of Catholicism and some Middle East Christians of Orthodox patriarchal lines. We do not hate each other and hating-racist culture or ideas come from the West. I always support my Christian friends especially those devout ones. Stop spreading those diseases from the West to Asia! 

Sometimes they talk about Arabs or Muslims (as Islam is the same entity of Arab like what they perceive to Christianity as their 'daddy's' handmade) trying to dominate the world, then later when we tell them that there are 100% Bedouin Arabs of Ghassan branch who are of Byzantine Orthodox Church under the Roman empire or Lakhmid Arabs who still exist under Nestorian churches since before the rise of Muhammad s.a.w, they would say they are glad that there are Arabs who resists the pressure of Islam. They would try to do all sort of thing for Muslim to leave their religion. When they leave their religion what those people who suggest apostacy can give to them? Mountain of gold? Food for the people who leave their religion until they die? Saving them from torments in hereafter if it is a common belief in other religion about hereafter? If he can help others, can he show people that he could also save himself from torments and sufferings? If zillions of people become apostates of their religion and choosing your religion because you offer them something, will you be able to cater everyone with their needs as the "change" for their "faith"? What for quantities if people who claim themselves in documents or just because being offered by something are not sincere because of the God but because of their belly, their desire, their comfort. In the end, the real god for them are their belly, their desire, their comfort, etc...

Don't they read the Judaism 13 articles of faith concluded by Musa bin Maimun which is a Judaism teacher about the path that the God teach human-being never change? Sure they don't read it because they are Christians who zealously "following" the Christ and that is what they are called as... Christians... Later they call us Muslims as Mohamedans like our concept of how we view the God is the same like them. Our God is not Muhammad s.a.w... Muhammad s.a.w is a sage, a teacher, a messenger of the God like his brothers in soul such as Moses, like Jesus a.s, like Noah a.s, like Abraham a.s. We worship only the God...! We do not need Trinity nor anything taught by Church Fathers with the regard on dogma and creed and we don't need those teachings in Protestantism or Catholicism which has been around longer than Protestantism to have faith in Jesus Christ. We believe and have faith in Jesus a.s and those who are mentioned by the God in glorious Quran. We love all of prophets and messengers of the God no matter Muhammad s.a.w, Moses a.s, Jesus a.s, Noah a.s, Abraham a.s, Ismael a.s, Isaac a.s all equally. We have our own sciences about the creed and faith and we have our own scholars.

I memorized the articles of Jew faith perfectly in both Hebrew and Arabic and one of it says that : "the God will never exchange or alter His law for any other for all eternity."

Is it hard to understand that celestial revelation does not come in certain period or being known to the person who transmit it in this sense like Western understanding when they call Muslims as Mohammedans or Christians for those who follow the teachings which flows from Jesus Christ. Revelation as a sign of His Mercy toward the universe will descend each time when human-being fallen into the darkness or human-being simply love to play ignorant? Why when you (Western Christians) talk, you have to use religion as the shield to protect your attachment toward worldly desire? Don't lie to people around because the God knows what is hidden in ones' heart. Don't also assume that the God is STUPID! 

This kind of people according to the pillars of morality is considered as polytheists no matter how they claim that they are worshiping the Supreme Authority! So, what had been said by the God is true... They hated Him but His Words will never be eliminated by these flies. This universe is under His supervision and not under those hypocrites. Their heart is filthy with polytheism. If people hate the God, then say so, no need to use the pretext of this nation or that nation or this religion or that religion. If they wanted to dominate others, don't accuse it on others like throwing stones to others while others are not looking and then hiding the hand.

When the soul of prophet Muhammad s.a.w being raised by the God, we have the Quran and the prophetic tradition. We know our goal of life in which the purest goal of life is to see the God. We do not consider this earth as our possession. When I was a Buddhist, I also believed the same thing. I am not I am or what is concluded in Anatta and Sunyata concept. Nothing in my physical body is true and everything around me is fake. When I wanted to die and performing some difficult tapas (meditation) according to Hindu-Buddhist ways I believe that I could transfer my soul into a better place than this physical body because it is fake. There are some Buddhists of Lao descents who live in the U.S Long Island, usually they are rich people who ran from revolution in their country and they live like the average Americans and sometimes visiting Thailand to boast around. They keep throwing racist stuffs to Chinese people in Bangkok or Muslim Malays in Southern Thailand and when I talked about Anatta and Sunyata concept, they just keep their silence. So, it means that people sometimes know about the stuffs but they never practice whatever had been taught but they claim themselves as this and that. Later they try to ban others without they first understand the essence of the teaching that they claimed to follow.  

Through deductive and inductive analysis on Islamic Shari'a sources, it confirms that the goal and intention of shariah is to attract benefit and goodness for human-being and environment. It is rejecting harms from human-being toward environment. All of law provisions under the shariah jurisprudence shelter under the concept of the guarantee for human-being and environment benefits. It is not only the benefit of the world but also the hereafter.     

Al-'Iz bin Abdul Salam in his book Qawaid al-Ahkam fi Masalih al-Anam vol. 1 page 9 said that Islam (path) is for benefits. It is either bringing benefit or avoiding harm. The sermon that we just heard from Islamic Center defines on the meaning of maqasid or the goal and its position. It tries to elaborate in the most comprehensive and easiest way on various categories of goals according to variety of perspectives, benefits of understanding what is the goal and how to recognize the goal. And then to evaluate the goal on how important is the goal of shariah in the evaluation of certain decision made.  

Introduction to the Concept of Maqasid

What is the definition of maqasid? 

According to Ahmad al-Raysuni in the View of the Goal by Imam al-Shatiby (1992, p.g 13) : "Maqasid means the goal, the objective or the purpose which we wanted to achieve in doing something. In this context, the objective which is placed by the path in molding the provisions. Among popular terms used for this maqasid shariah, maqasid shari' Allah (the objective the God's path), maqasid shari'iyyah."

There are many definitions brought upon by the scholars of the origin of understanding about the goal or the objective of shariah. Classical scholars never propose any specific definition for the goal. Al-Shatibi who was the apprentice of the objective branch of knowledge also never provide any specific definition. But it does not mean that they had neglected the objective or the goal of certain provisions in the law.

There are many views regarding the objective in their scholarly works. We could also see various classical scholars' views which forms the elements of contemporary scholars preceding them. What is certain is that the values of objective in the path is consisted in the al-Quran and prophetic traditions.

Some of scholars assume that the objective signifies the benefits, whether it attracts benefit or it rejects the demolition of human civilization. Ibnu Qayyim al-Jawziyyah emphasized that shariah is based on wisdom and benefit for human civilization in the world and benefit them in the hereafter. The changes in jurisprudence and law could also take place according to period of time and place since it is flexible according to human-nature, cultural background and environment. It guarantees the benefit of human-being as a whole.

Some scholars define the objective as the matters which avoid harms toward human-being and environment. The jurist I'yad said that : "providing provisions within the framework of the path of the God is obligatory." Some characterize the objective as a way to avoid trouble for society. It was mentioned by Ibnu al-'Arabi with his statement : "There is no burden on someone if he is not capable of it." 

Some had understood the objective of shariah with five basic principles of Islam. Islam (the path of the God) is to protect :   

1. religion
2. soul and life
3. mind
4. pedigree
5. property

In other angle, there are also classical scholars who view the objective as the logic to be integrated as apart of the decision in making the judgement in the court. Contemporary scholars such as Imam al-Shatibi who are famous in the science of the objective never propose any specific definition for the term of the objective or maqasid. He perhaps assumed that everybody understood the term.  Try to compare them with principles of Civil Law and the whole process in Civil Law instead of attacking something which we don't really understand at because we are not even lawyers to begin with, lol....

This gonna take long because we learn about Civil Law or Common Law for racist Western society and their religion (whatever ideologies they proposed are their religions) for about 4 years to be a practical chambering lawyers or attorneys while we read something in the surface about Shariah and assume ourselves as professionally a Law attorney to criticize this and that, hahaha....

お腹がすいた

Assalaamu'alaikum wa rahmatullah


I can't eat anything since yesterday. There isn't much choice in our campus or around the campus and considering Penang is a hard place to find proper place for food though it boasts with it's Nasi Kandar and other Chinese cuisines. Well, it's hard for a person without a car nor motorcycle like me, hahaha... Most of Chinese cuisines around are non-halal even the vegetarian ones could still make people doubtful. I can't really take Indian food or anything related to it because they have too much spices. I already tried hard to adapt and I am not trying to be a pain in the ass but I can't...  I had threw out everything when I returned to my room from canteen, that was so embarrassing!!! Fortunately nobody saw me.

Usually I will only become a veggie. The rice at the canteen was horrible but I avoid complaining to the Malay makcik because she might had tried hard. One of a phd Filipino guy had also complained about the rice and side dishes cooked in other hostel. Usually when we do business in large scale this kind of situation is unavoidable. 

I think I need a refrigerator and also an electric pan or rice-cooker... We have department store here but I can't store those fresh stuffs nor cooking them. I'm sick of foods cooked at restaurants and I am just wasting money for something which would be thrown out... Urm, just see if I am crazy enough to carry those stuffs after I buy them...

First I would keep this recipe that I get from sites here for Sukiyaki... If I can't cook here I wanted to do it at home and dip my head into the pan, hahahaha... Need to modify the recipe because sake and mirin are non-halal...

Sukiyaki Sauce

100 ml vinegar (2/5 u.s. cup)
50 ml sweet soy sauce (1/5 u.s. cup)
50 ml soy sauce (1/5 u.s. cup)
2 tbsp sugar

Raw Items

Beef 
Eggs
Tohu

Vegetables

白菜 Hakusai chinese cabbage
Negi (spring onion)
春菊 Shungiku (chrysanthemum)
椎茸 Shiitake mushrooms
榎茸 Enokitake mushrooms
小松菜 Komatsuna Japanese mustard spinach
糸蒟蒻 Ito konyaku Yam noodle

How to make?

Mix vinegar, sweet soy sauce with sugar. Boil them and wait until it simmer. Slice those raw items. Slice vegetables just to make it easy to eat and being placed into the pan. Put the sauce into the pan and put beef into sauce. Put chinese cabbage and tohu. Put ito konyaku but don't put it close to beef. Put mushrooms and mustard spinach. Put some more sukiyaki sauce when it began to dry up. Wait few minutes. We can also add eggs, have some rice and have some udon with it.

I was just too hungry... Just had a bowl of vegetarian instant noodle and later dipping some wholemeal bread in it. I imagined that I am having Sukiyaki... hehehehe... Previously in the age of my ignorance, I sometimes ate Japanese style foods with those alcoholic stuffs mixed in them such as sake or mirin. I didn't care even if there were pork elements or other things though elders are religious and strict. We perhaps also cook raw things and eat them together. Usually we would do crazy things with second sister. 

We wasted our money in Japanese restaurants and watch movies in theater when we wanted to celebrate anything just to release our boredom and tense. Quite funny that last time, I guess around 7 years ago, second sister and I ate like swines in a Japanese restaurant in KLCC and both of us almost fainted when the bill came to us. We had to pay RM90 and before that we didn't bother to check prices at the menu... After that I drank all of the shoyu and mirin in the vases on the table because we paid expensively and we must appreciate our money. 

Though I didn't take fish for long and I have to avoid seafood now but I still could take those like seashells or abalone by closing my eyes. I will perform ritual bath and ablution after taking all of those stuffs in order to validate the performance of prayer services since we live in a country mixed with other population. Sometimes when I go to relatives houses, I would have to take whatever they give me as to be polite to them and it also include seafood. Abalone is expensive, yah!

At our home, only three persons have their appetite more to Indian whom are my dad, my younger sister, and my third sister. They are used to curry. For me, the way to cook curry at home is different with the way it is cooked at Mamak restaurant. They used too much spices in curry and the spices used are fierce. We only use spices which are light like cinnamon. Malay curry and Indian curry is quite different.

What is Adzan? It is Creepy!

Assalaamu'alaikum wa rahmatullah

A person who calls for prayer is called as Muezzin. The first Muezzin was Bilal bin Rabah, a black man from Abyssinia and black were exhibited in democratic European human zoos during colonial time as animal for the Jakuns Europeans.

Peace be upon everyone and blessings of the God be poured on those passing by. I have had heard this issue for long about adzan where some in Europe believe as scary since they do not understand what has been uttered from the minaret. They said, bell at the church tower is not scary as the adzan. Everybody has his own opinion.

Some of my Muslim brothers and sisters also said that listening to church bell or Catholic church organ makes them feel creepy like listening to some ghostly rhythm or being in creepy scenes in vampire movies. People are always afraid of things which they are not familiar with or things which they are not sure about. 

Now I am here to help people especially Muslim ourselves understand what is adzan and at least when 'some' people who do not believe do research, and they are lazy to do interview; they may perhaps checking some information from a practicing Muslim. 

What exactly is adzan??? Adzan  is a special utterance practiced by those who submit themselves to the God as the sign that a prayer service to honor the Lord of the time will happen. It urges the faithful community and people around who hear it to come into the congregation and together performing the prayer service. It is a phenomena for five obligatory prayer service time at every masjid worldwide. It will stop only when the world comes to its end. 

Where Does the Word Islam Comes From?

Before that, why I don't use the word Muslim instead I am using people who submit themselves to the God? Because people only take the word as it is. They have no effort to understand what exactly the origin of the derivative nor eliminating ignorance.

What??! Islam means peace?!!!! WTF are you talking about?! If Islam means peace, why "you" slaughter this and that and s**t and **** bla... bla... bla...

I know all of these s***s will come out of certain red necks and those who suck them up in Asia. Make sure to brush teeth after meals and balun beer ya, hehehe. I am familiar with those kind of barks and do I care? Na'ah... LOL...

People have their right to say anything they want. Those filthy words we could see everywhere in comments of many sites. We talk about religion, path of life, and matters which cleanse our souls but in the same time we throw out filthy words, thinking that we are holy amongst others, and we had forgotten to purify ourselves of evil thoughts no matter in what condition we are... ironically : ) This applies to all human-being... No matter whether a person calling himself or herself Muslim, Christian, Jew, Buddhist, Hindu, Zoroastrian, Sikh, Jain, Taoist, and what else the name that people identify themselves as adherents in the world?

Arabic, Aramaic and Hebrew are all sister languages. They are of Semitic origin, the children of Shem bin Noah. The origin of the word Islam was actually spelled as Sleem. We have Sarf for phonology of words linked to Nahw or grammar in Arabic but too bad English, French, Italian, German and other European languages has no well built phonology subject. Ancient and well-developed languages like Arabic and Sanskrit has well-built grammatical systems. Most of Arabic speaker students fail this subject. However, we in South East Asia had preserved this lessons and most of South East Asian religious studies students no matter whether they are of Arab descents or natives memorized the lessons and practicing them in speeches. 

This word "sleem" which forms the word Islam and later Muslim to signify a person who embraced Islam or choosing Islam as their path to reach the God. Islam is actually derived from the Name of the God. The God possesses Most Glorious and Holiest Name. It is mentioned in the glorious Quran. I still remember when I was a young child maybe around seven to nine years old, we always recite His Holiest Names before we begin lessons and I was first introduced at home with Arabic alphabets and not Roman alphabets so when I entered National School I also had problems to spell and write, so do my younger sisters. We recited : "He is the God, there is no gods but only Him the Most Compassionate, the Most Loving-Kind, the King of the universe, the Most Holy, the One Who grants Peace, the One Who keeps promises.... and so on..."

We are also encouraged to pray for each other as a greeting with assalaamu'alaikum wa rahmatullahi wa barakatuhu which means may be peace descends upon you and with His boundless Compassion, and His boundless Blessings

The word related to Peace is actually derived from one of the Name of the God. It is not a human name and languages came from Him. We are different from Jews or Christians in this sense where we do not identify ourselves with Muhammad or his tribal identification as what had been written by Western writers. That is why we do not greet people in certain dirty places like in toilet or lavatory and in certain circumstances. The Jews also have this rule because I indeed have some Jew acquaintances. Those Orthodox Jews always greet others with shlom'aleichem and some Syriac Christians who speak Aramaic also greet other with shlumlakhum. All have the same meaning with assalaamu'alaikum which I also use to begin my posts.

Again we emphasize to everyone. The God of all the human, creatures and universe is none other than Him. Human build up concepts to view Him and human have their own religious history regarding dogma and creed. People could be childish all they want but soon... They will realize the reality of life where all of human-being possess negative qualities and not angels. That's why human have religions and why human need the teaching of morality : )   

Background of Adzan

Usually a Muezzin will call for the prayer services from high places, it could be on hills, minaret of the masjids, or any high places. Nowadays we have technology like microphone and if we do not accept technology, won't we be called as backward and could not get along with modernization?

Idiomatically adzan means the herald. It is synonymous to the exclamation. Adzan is a combination of certain words signifying that it is now the time for obligatory prayer services or the herald that it is now the time for an obligatory prayer service. A person will take charge to herald this and that is what we hear from the minaret of masjids or from the microphone in masjids across the world. 

Its Position within the Law 

Its position within the law and tradition is encouraged while we are about to perform obligatory prayer services. I don't know how to translate this concept of sunna muakkada. Our translation and interpretation lecturers never taught us on the language of shariah. We only learned about Nida and Bible translations and later about editing of newspapers and stuffs. Now it is on my initiative and brothers and sisters to make lists of shariah terms and concepts because we have large corpus of shariah terms in Malay but we never do translation and adaptation to other languages. It leaves people in ambiguity and I am not actually supporting the usage of other ritual languages rather than Arabic because Arabic is better but people need to understand or else there would be of no use to embrace something that we do not understand.   

Then, it is obligatory for a person in a community or a group to take charge to call for congregational prayer services when obligatory time to honor the God is coming. We call this as fardu kifayya and I had explained the meaning more or less. If only a person in an area and there is no people for congregation, then it is considered as an observation of prophetic tradition. There are merits for observation of prophetic traditions but no sins if they are not observed. If there are a Muslim community, then one of the community must take charge to call for obligatory prayer services. Women are only encouraged to perform other form of adzan which is called as iqamah only among them as to prevent them from being slandered if they raise up their voice. 


Evidence in the Quran and Sunnah

The Quran, the Sunnah, and the agreement of ulamas stated that adzan has many benefits and its merit is great. The evidence from the Quran surah al-Maidah verse 58 mentioned about the exclamation...

Says the God : "When you are exclaiming to (perform) prayer services, they take it as mockery and something to make fun of; that is because they are the people who possess no mind (to think)."

Evidence from prophetic traditions covering many hadiths. Among them is from the narration of Bukhari and Muslim which sounds : "When the time of prayer services is there, one of you must perform the adzan and the elder among you must be the leader of the prayer service." This is one of the reasons I feel not comfortable to be imam in prayer services in my hostel because there are many elders in our hostel musalla. Unless if it is very very crucial, then I would not question anything.

How Adzan Began to be Practiced?

Adzan was practiced by Muslims in the first period of Hegira. In a hadith narrated by Bukhari and Muslim from the report of Ibnu Umar r.a : "In the beginning of Meccan Muslim migration to Medina, they had assembled and waiting for the time to perform daily prayer services. At that time, there was no adzan yet. One day, the noble prophet Muhammad s.a.w had called all of his companions into a meeting on how to herald the coming of prayer service time and how to call people to the masjid for prayer services. There were few suggestions regarding the herald about the time. Some had suggested that they should show up flag to denote the prayer services time so people who see it will come to the masjid and pray together. Some had suggested the sofar (whistle) being used to call people. Some had suggested bell as a mean to denote the time and to call for congregation. 

However, Umar al-Khattab had suggested that it should be more appropriate and natural with just the announcement through human voice and just saying 'it is now the time for prayer service.' Muhammad s.a.w accepted the suggestion of Umar al-Khattab but he changed the wordings with 'let us perform prayer (charity).'

One night a companion whose name Abdullah bin Zayd had dreamed about more better way to announce the prayer time with the beginning of the word are God is the Greatest and so on... The morning after that, Abdullah bin Zayd went to see prophet Muhammad s.a.w and talked with the meeting. Prophet Muhammmad s.a.w said that his dream is a true dream. The prophet Muhammad s.a.w ordered another companion, Bilal bin Rabah to proclaim the herald. After listening to wordings of the adzan, Umar al-Khattab then came to the meeting and said that he dreamed the same thing and his dream was the same dream as Abdullah bin Zayd."

Al-Bazzar narrated from a report that : "The messenger of the God s.a.w during the night of Isra' had been shown and listened to the adzan at the seventh heaven. Then the archangel Gabriel a.s came to him and he became the imam for the members of heavens. Among those members of heavens are Adam a.s and Noah a.s. The God had completed the noble value of him on the inhabitants of heaven and earth."   

What Is Uttered in the Adzan?

Straight to the point without Arabic parallel texts because it might make monolingual people dizzy. People in Middle East are actually bilingual people and I believe around the world there are many bilingual or trilingual people. Usually Christians in Middle East could also speak Arabic, Syriac, and Greek and they use all three languages in parallel in their prayers. 

For us Muslims in South East Asia, some of us would do supplications in native languages and only obligatory rituals in Arabic. Like one of a Malay brother in musalla had also recited supplications after obligatory prayer services in Malay, and it is not wrong. People who could not understand Arabic also understood what he said. Adzan in Arabic that everyone listens from minarets of masjids means....

Shi'a Muslim brothers might have a slightly different adzan but just one addition regarding Ali k.w. Nothing really different. So, when we understood things we won't be paranoid right? Or some people love to scare others away with something which does not really happen? Its like a creation of negative perception for example don't go to the forest lest you will see a monster, a demon, a ghost, and etc negative by some village folk parents to scare away their children from going to certain area since they are lazy to answer questions that will be posed to them by their children after they know what happen in the forest while the parents are lazy or just perhaps became chickens since they are also influenced by their imagination, hahahaha.

Then we have supplications after the adzan which means in English.......................

Dear the God our Lord, please be in contact with our prophet Muhammad s.a.w and his family as You had been in contact with our father, Abraham a.s and his family. Dear the God our Lord, please bless our prophet Muhammad s.a.w as You had blessed our father Abraham a.s. and his family.

Dear the God Who Dominates the perfect exclamation and the prayer service which is being performed. 
Please make the prophet Muhammad s.a.w (for me) as a rope which connects me to You and a priority for me. 
And raise prophet Muhammad s.a.w with the appraised position as what You had promised for him.

Egyptian Movie : 'Asal Aswad

Assalaamu'alaikum wa rahmatullah

Egyptian movie had been very influential in Kedah around 1950s until early 1960s. Around 1960s, movies from India also penetrating Kedah state in the theaters imported by Chinese towkeh (businessman). A little town like in Kodiang of Kubang Pasu district also had a theater called Panggung Gembira Sentiasa

Presenting everyone a movie about American-Egyptian returning home to Egypt after 20 years stuck in the US. The title means Black Honey. The main character Misriy Sayyid el-'Arab (Muhammad Hilmy). His Arabic is kind of cute, hahaha. I tried to imitate him talking in Arabic with American accent while I am alone in the room and having a good laugh.

 

Basically this guy has American passport and nationality but he keep telling people that he is an Egyptian. And he speaks Arabic so people who had treated him well in the beginning turn to be harsh to him. Check at what happened in the passport control since he was convinced by the person who sits beside him to fill disembarkation card with Egyptian as his nationality because he told the guy that he is an Egyptian. 

There is also a scene about how dirty Egypt is when the driver who takes passenger at the airport throw out thrash from the window and the American-Egyptian stopped that guy from throwing thrashes out of the window. Not to forget low-cost ink used at the newspaper painted at his fingers, hahaha... Also scenes on how horrible Egyptians way of speaking English for e.g an English teacher pronounced class as keelaus... Thank you ferry mash... (Thank you very much). The character also has a tattoo if everyone notice that while watching.

Basically one doesn't have to understand the movie, because we can see their expression. Muhammad Hilmiy is one of my favorite actor, haha. I'm sorry to non-Arabic speaker, it's without subtitle. I wish everyone stumbled by enjoy different angles of view from Northern Africa and Mediterranean region. So, what everyone think about an Orthodox Muslim guy watching movies? I'm not following others but this is one of a way on how I observe the world and around. It's not only for entertainment while I am bored. It makes me feel wanted to visit Egypt too, omm ed-donya (mother of the world)... bahebbak awi awi : )

Arabs Involvement in Economic Activities in Kedah

This post is based of Dr. Zahidi Zainol Rashid research from the Kedah Library Corporation. It is very interesting to read research from local researchers because we only read something from Western writers about our community even in British Malaya.

Not many of us actually are aware about our own community since we had been registered as Malays in Malaysia. Even some politicians in Malaysian national party and those involved in business like Mr. Syed Mukhtar al-Bukhary are also of Arab descent. I had checked his details in wikipedia and his ethnicity status had already been changed to Malay from Arab descents ya. You get business and you lie about your self yah... I don’t think that I am eligible for native rights for now if it is according to most of our compatriots thinking though we had been here for more than 300 years because we as individuals do not really receiving proper assistance in our life from political game. Some people also do not like Mr. Syed al-Bukhary since we have current issues like the digital TV so everyone is entitled to their opinion and inclination. The issue doesn’t really bother me anyway, haha. 

Supposedly we are registered as the Arab descents or just Arabs and not of other ethnicity identification but the British authority had converted everyone into Malays just because many of those who live in the state are fluent Classical Malay speakers, wearing sarong, married to Malay women or men, eating rice and working in the field. Thanks to British ‘master’ teaching of nation-state where everyone is compulsory to be converted into a particular race as a religion. 

Why can’t we be entitled to native privileges with our own ethnicity identification or just known by our religion while in our state, we are already considered as integral part of it since hundreds of years before independence granted by Her Highness Queen? I am also researching the same problem about Muslim Indians, Bangladeshis, and Pakistanis in Britain where they were told as trying to Islamicize Britain into Britishstan with Shariah, "Hand-Cutting," or Hijab zone. Perhaps some part of the threaten are true but I just personally think that Europeans are always paranoid of everything because they never really mingle with people around instead of boasting here and there. In this case, we are of the same religion people where Malays and Arabs are Muslims but with different racial background in the political frame taught by British. You British are our teachers…

I had also seen many Muslim Indians like in Penang racing among each other to get Malay status but they speak no Malay at home and they look Indian. They read and write in Tamil while calling themselves Malays. They also eat thoshai, curry, murungakai, raasam, payaasam, and etc and not Malay cuisines at home. Compared to my Hindu classmate whose name is Prema, she said that she also had rice like Malay at home and she does not know how to read or write in Tamil. Most of them are Tamil and Kerala Muslims and they had also married some Arab descents and hijacked the term Jawi Pekan from us. One of my cousin sisters who live in Penang is also married to a Muslim Indian and the guy family speaks pure Tamil but being identified as Malay. Isn’t it bad to lie? Our state had also been integrated in federal system of the country with centralized power in the south. I would actually prefer to be known as a Muslim like our Chinese national friends who are all considered as Hui but they speak Chinese like the majority of Han ethnic. We are indeed Muslims who believe in the God and the prophethood of Muhammad s.a.w, so we are not lying about ourselves in this part. Would it be better?

If we are forced to use nationality, then I would prefer to be known by my state identification, which is Kedah. Everyone in our family love our state and it would be called as kenegerian (spirit of a state) by others in urban areas which is in the southern states and considered as not patriotic toward Federal government which is also located in the southern part. I saw that Johorian are also kenegerian while nobody say anything to them.  

I faced problems in other states other than my state too. Those like in Selangor had discriminated us when we just arrived from other state so I mingled more with Chinese friends at the neighborhood. It was like we were foreigners in our own country. I understood how some Kelantanese feel but we from Kedah are not like Kelantanese with our groups. 

We are usually independent to ourselves and we try to mix around as possible as we can. I had also adapted myself into Chinese environment of Cheras of Kuala Lumpur when I was a young child before we moved for a moment to Kedah. We speak, we eat, we entertain ourselves and we behaved just like our Chinese neighbors. We have to survive in pressures when we migrated to other area even as young kids. So, that is why many people stumbled by would see a guy who is telling a “chaotic” young kid life. Growing like an isolated Chinese or Indian kid while not considered as a compatriot by others because some differences in our selves. 

We had also a neighbor from Egypt last time and she is married to an Imam from Terengganu. Her children are poor things. I saw them being treated badly by Malay kids when they tried to befriend them. All of them could not excel well in school too but they are not really lazy or stupid. I and my sister felt like crying when looking at the report card that they had shown to us. They speak Egyptian Arabic at home and that perhaps being a problem for them when they were registered by their father into national school. Inshaallah, I would also paste here a video, actually a movie starred by Muhammad Hilmy about an Egyptian Arab man who is an American by nationality had to face troubles in search for his own heritage in the mother of the world. Perhaps if I go for Yemen and speaking in Arabic, I would also being treated the same like the character played by Muhammad Hilmy, hahaha.

The Arabs in Kedah were divided into two kinds of Arabs. One is of Sayyid descents of Ba’alawi or Alawiyyah. They are the descents of Hussein bin Ali k.w and Fatimah binti Rasulullah s.a.w. Most had arrived since 17 C. Before their arrival in Kedah, they had already stayed in Palembang, Acheh, Jambi, Singapore, Patani, Burma, Penang, and Perak. They came from many places in Yemen such as Sana Shahrir. Later they settled down in Kota Setar, Kuala Muda, Yan and Kubang Pasu. Our ancestors settled down in Kota Setar and Kubang Pasu. They had also married women from Gujarat where a village in Kubang Pasu was known with people of Arab-Gujarat descent and they were not even Malays to begin with. There is also Arab community in Gujarat province of India which is known as Chawsh

Some people might say muka belacan to people who call themselves Arabs now but for me I just do not want to lie and it is not that I wanted to boast about it. We realize that we look more Mongoloid than Arabs or Malays because of our mother genetic. I don’t take shrimp paste and I don’t take seafood as it is not permissible in our manhaj. I am not sure how belachan or how mongol I look like. Usually I would be mistaken by Nepalese migrant workers as one of them; some Punjabis (Western Indian) had also talked in Punjabi with me. When there are majority of Northern Indians or Arabs in a certain place, I would feel comfortable and mingle more with them compared to Malays. We also have the right to learn our ancestral language which is Arabic, speak in it and first we have to realize who we are just like our Chinese compatriots realize about who they are. Chinese compatriots had taught me many valuable lessons. Nowadays most of all are just fluent in Malay or English. Some perhaps speaking in Urdu, Chinese or Thai.
           
Those Arabs who were not Sayyid came earlier and settled in Kedah. Examples of them are Syeikh Ahmad bin Syeikh Ja’afar Qamiri, Syeikh Ahmad bin Syeikh Salleh Mawtti, Sheikh Ibrahim al-Biyari and Sheikh Abdullah. Sheikh Ibrahim for example was invited by his highness Tunku Mahmud, the brother of our beloved Sultan Abdul Hamid who ruled around 1882-1934. Sheikh Ibrahim was also a Chief Imam and a teacher of Quranic lessons.

Early stages of their arrival, the Arabs were visitors and traders. When Islam emerged again after the darkness, many religious science teachers and missionaries also arrived at the port and they settled in Kedah. Arabs as an integral part of Kedah society had been involved in political development in Kedah.

Many of Arabs from Sayyid descent are the Shahabuddin clan and they are the majority clan in Kedah. Most of them came from Hadramawt but stayed for few moments in Palembang, Acheh, and Pulau Pinang. Barakbah clan had arrived from Indonesia and from Yemen. One of a Sayyid who held an office in Sultanate of Kedah government was Sayyid Muhammad Aidid. He was a Secretary of Kedah Sultanate Affairs during the reign of our Sultan Abdul Hamid

Kedah state nowadays is known as the oldest state in Malaysia. We have historical tracks based from archeological excavations, written sources, and inscriptions. The Kedah Sultanate had already proved that it has a well-built society, possessing a state element, and employing its own political system. The emergence of Kedah kingdom since ancient time as a well-developed trading center and famous around the world was a factor which relates to the arrival of Arabs into the Kedah kingdom. 

Urmmm... Please don’t throw out... We also want to have pride of ourselves like Europeans and telling everyone around how marvelous our states are although our state is just a small state compared to the EU member states or even Sarawak in our federation, hehehe. I also felt the same in our classes learning about how magnificent Europe is. It does not count the US yet where some of my friends are also worshiping the US as their oracle with the influence of American movies and entertainment stuffs like American Idol, Justin Fag Bieber, Lady Ugly Gaga and etc.

The significance of Jerai Mountain in Kedah plateau for ships that sailed and the dependence on the monsoon wind and economy value in Kedah also became an important factor in the questions of the Arabs’ arrival in Kedah ports. The result from Kedah Malays with those people in Arabian states and the coming of Arabs themselves had earlier spread the light of Islam to Kedah kingdom compared to other states in Malaysian Peninsula today. 

The Sayyids are known for their profession as traders and they were making life from business. Just like Chinese and Indian in the cities. Other than trading, some of them were also involved in agricultural activities. For those Sayyids, agricultural activities like paddy cultivating are considered as new way of making a living which their forefathers had never done it before in Hadramawt. Those in Hadramawt only know a kind of plant which is tamr or date tree. So, trying to do paddy field was quite difficult for these Arabs since their life was based on the character of desert and it is different from trading.

In trading field, Arabs had traded various kinds of spices, clothes, books, and jewelries. Before the arrival of British in Pulau Pinang, the Arabs depend solely on business and trading and had controlled some parts of Kedah Sultanate economy. Arab communities did not only concentrated in particular areas in Kedah but they live all over Kedah Sultanate. Their nature is more inclined to business and trading. The Arab traders had already penetrated the areas of South East Asia since before the re-emergence of Islam. In the beginning, they just wanted to do business and trading and later bringing some profits from business to their states of origin but later they ended down here with settlements.  

When Islam was propagated again by the noble prophet Muhammad s.a.w, these Arabs had also brought together the teaching and propagated it to natives. They had left their family and their lands to propagate the teachings. Then they settled down in foreign lands and beginning new life. Due to their condition in foreign land, they have to survive through business and trading since they had no lands. After that, the court of Kedah had also support them so they had more opportunities in economy where the economy of traditional Malays were fully controlled by the rulers.  

Arabs at that time had the experience in business and they had good relation with court. The court had also opened for them the opportunity to run business as the right to do business was only granted by royal decree or by certain authority decided under royal permission. Only the sultan has the right to permit anyone he favors to run business in his territory.      
          
Many Arabs had already successful as entrepreneurs where they had also possessed companies and became directors of companies. It has to do with their experience in business beside they possess large capitals and strong basis in business. When British arrived from Pulau Pinang, Arabs economic survival had also been challenged. Then, they had also have to compete with Chinese merchants after Chinese penetrated Kedah market. From that on, they began to get involved in groceries shop business as well. I see, that’s why many of our people now trying to use other identification in securing their business survival and the mamaks had imitate it.

The impact from the competition of British and Chinese had made Arabs moving far into rural areas. Beside doing business and trading, they also trying to do agricultural and became landlords. Some of the lands were granted by the Sultan of Kedah as the lands in Kedah was the possession of the Sultan. The Sultan has every right on the lands and he would stamp the seal with the signature of the Regent. 

Thus, many of those paddy lands and farms being transferred into Arabs possession with the permission of our Sultan. But many of those Arabs had also pawned the lands to Chinese merchants to get quick money. For e.g in 1911, the rights for duty import collection on timber being granted by the court to Sayyid Othman from Yan district but he had pawned the right to a Chinese merchant for $ 400.00 per year. Many of Arabs during this period of time became bancrupt.

These recent, there are also Arabs who tried to involve themselves in agriculture and fishing industries. They were landlords in Yan, Kota Setar, Kuala Muda and Kubang Pasu districts. They were also active in renting their lands to others and never work on their own lands. They just love to stay at home and take everything for granted. 
 
Their attitude is related to the importance of status and their position as aristocrats and noblemen who possess properties as what had been viewed by Malays as having big houses complete with facilities and they have less working hours.

Paddy field is a main economy source in Kedah Sultanate during the time of British Malaya. With 12 miles early channel of water developed by subjects of Kedah Sultanate had made paddy cultivation become more advanced and Kedah could also supply rice to other areas as well. The water channel project of Wan Muhammad Saman and other figures like Syed Othman who had pawned his duty rights to a Chinese merchant had also involved with the regard to his area of supervision in Little Yan district was quite succesful.

Small portions of Arab communities became fishermen and there were also poor Arabs in Kedah since they only worked with others. They refused to admit that they were Arabs or even of Sayyid lineage. They had ommitted their Sayyid title as they were ashamed of their life if compared to other Arabs in the state.

During the reign of Sultan Ahmad Tajuddin Mukarram Shah (1854-1879), there was a new position given to an Arab with the name Syed Muhammad. Syed Muhammad became a captain for a ship and was ordered to maintain and looking the ship with two sails bought by the Sultan from English.

Early history had shown that Arabs directly was involved in most of religious posts and affairs in the sultanate. When Kedah was surrendered by the empire of Siam to the British empire, all of the posts were paid with salary. Main posts like the mufti, judges, imam and others were held by Arabs. In education, they held postions such as directors, headmasters of religious and English schools, and supervisors of schools.  
     
Regarding lands, last time I heard that elders had also fighting and quarreling over lands until some of them had to run to Southern Thai as it turned into bloody conflict. We had also sold our grandpa land for dad’s part in Kodiang in Kubang Pasu district. Mum had forced dad to sell his inherited land when I was in the second year doing my first degree because it was not easy to maintain the land for paddy and considering that the family who rent the land didn’t help us to pay the tithe as they are non-Muslims and we are not living in the state so it was difficult for us to monitor renting rate and tithe for crops. The land was rented to a Chinese  family under the surname Hooi. After the land being sold, I heard that dad cried on the land as he felt guilty to his father but what to do. The land had already been problematic since before it was inherited to dad and we had gone to courts for solutions but to no avail. Dad sold the land to a rich Malay man. I was busy at that time so I did not also look at the process.  I also do not want to inherit the land. It only bring headache.

We had also encountered many problems like being cheated and stabbed by friends or ‘relatives’ as we helped people without checking their background. I don’t know whether our custom is suitable at all of the time. We would consider our close friends even not related by blood as brothers or sisters. So each time close friends having problems, we would also been dragged into their problems as we would feel guilty to let them alone. It’s like we live and die only for the happiness and comfort of our friends, brothers and sisters. We also would repay back the goodness done on us. In the case, one of a Tabligh guy that I sheltered. Last time, he actually had helped me with internet password. It was not really a big deal but we see even small matters as big and we must repay back whatever is given. I always remember people treatment to me because I count everything. Even a cent that people gave me, I actually never forget. I keep every detail in my memory. Sometimes it would be so absurd and people would regard us as crazy or perhaps scary, hahaha.

Urmmm, the fact about renting the land is true. But according to dad, our grandpa was not a lazy man. This is individual case. He was a hardworking man and also worked as a seeker of fertilizers. If dad lied then I am also lying. Like in our case as individuals and not as groups, we do not live in Kedah but we have to migrate to other states because of family problem, fate and we do not work only as traders and farmers. Some of these Arab decents children had been educated in nursing schools in case of my aunties and my dad was educated in a Singaporean Catholic school just after grandpa died. He was 12 years old at that time and luckily he was not baptized though he lived like a person without a religion, without a mother to teach him because his mother died when he was three years old being casted by black magic and I always thought that Malay village folks always love to cast spell on others that they are envious at. This is my generalization on other ethnics. Why people around the world love to generalize things without looking at discreet root problems instead of trying to do interview with both sides either the pros and contras? Life would be easy if we can always do generalizations ya? 

What had been mentioned in this research is also right in certain parts, because I also met other Arab descents and I myself do not like their attitude. Most of them who are still rich today or filthy rich could we say, are arrogant and Westernized too. I don’t even consider myself as related to them but rather stay quite though we know each other. I don’t even dare to go into cousin brother house because my feet perhaps are dirty and I am not also close to them. 

Some of us also received and accepted religious teachings with the Mercy of the God. We soon realized our responsibility to propagate the faith and the noble life and morality to ourselves and environment. I myself never try to take any advantage from privileges but instead trying to strictly follow morality guidance of religion. I just live like a hermit, wearing clothes like a street wanderer, isolating myself if I did wrong to others, I hate possessions and I don’t want anything associated with world attachment like lands, money, or etc. We look everything at individual capacity can’t we? : )    

I think it is also a good idea for us to find more researches about Arab communities in our state. Because I saw that many of those "racists" are actually of foreign ancestral lineage and that means that they are the one who are tak sedar diri. They perhaps are afraid that their "rights" would be uprooted in what we call as attachment to the world. This earth is not our possession but the possession of the God, the King of the Universe. No need to boast about true blood, Aryan blood, strong race blood, genius race, or whatever it is. In the end everyone will be rotten in the grave holes and we carry dirty things in our intestines. Look at everyone first as a human-being and whether he is a God fearing person or not. We do not look as this race or that race or looking at their status or position in society because the God does not care about that. He is far More Great, possessing Dominion, and Rich compared to anyone in the earth or heaven. I had talked about this with a Malay friend too in our discussion maybe I could make a post about the discussion regarding our experience : )

Jurisprudence : What is Fiqh or Jurisprudence?

Assalaamu'alaikum wa rahmatullah

This is the Chinese or perhaps Sino-Japanese depiction of King Yama. Buddhists always talk about him when it is regarding punishment that a person will get as a way to cleanse up one's karmma. Usually elders will threaten youngers that King Yama will cut our tongue if we tell lies to others as lying will also bring bad karmma. King Yama is a judge and the guardian of hell. Hindu-Buddhist kingdoms in South East Asia also had used Brahminical texts such as Tharmmasastram to derive code of conduct and legislation provisions in the kingdom or anachakra ruled by a king or chakravarttin. One of the law practiced in ancient Buddhist kingdoms such as of ancient Malay kingdoms are like Sulo or impalement to execute a woman who commit adultery or treason against the king.

We have many branches of knowledge and sciences in the studies of religion after the noble prophet Muhammad s.a.w who is our seal of prophethood had returned to His Mercy. One of them is called as Fiqh

So, straight to the point, what is Fiqh brethren? Roughly it is a science related to the Islamic jurisprudence. It is an expansion of the code of conduct where we call it as Shariah and expounded from the glorious Quran. Shariah usually is supplemented by the tradition of prophets and we call tradition as Sunnah of prophets. Sunnah of prophets were re-introduced again by the noble prophet Muhammad s.a.w and some came from him according to the period where he live. Shariah which consists of the conducts of life from the sources of Quran and Sunnah then will be implemented through rulings and interpretations of jurists whom we call as Qadhi

Sometimes I would also refer to Jesus Christ as a future Qadhi. I will always wait for his arrival and rulings if I do not die yet. It actually signifies the end of the world : ) We already have our own guidelines and we do not need others to teach us especially in our own countries. The God is teaching us with basic rulings and the observance of morality is considered as apart of the prevention of evil and crimes. We don't need secularism or French concepts of looking at this world. French are just human-being and human-being are imperfect. We also don't need Karl Marx to teach us or whatever ideology proposed by these people. Those ideologies are anathematized and not natural. I would translate the word anathematize for my Malaysian compatriots as dilaknat.  We refuse to accept their ideas as they also refused to accept others' ideas. If they perceive others as barbarians, we also perceive them as barbarians. 

我詛咒歐鬼的思想... 他們多數人不接收啟示然後他們學的事沒有天的指導和聖靈... 別人都可以說出來他們的偏見對我們的道,我們的聖人和穆斯林所以我也想嘗試看感覺是怎樣,哈哈哈... 我感覺很...  

Fiqh deals with the observance of rituals, morals and social legislation in Islam. For Orthodox Sunnah Muslims, we have four schools of Fiqh established by four honorable imams which are Hanafi, Maliki, Shafi'ie and Hanbali. Our Shi'a Muslim brothers have two major schools of Fiqh inherited from Ja'afar as-Sadiq and Isma'ili Fatimiyya. Those who are trained in this science will be called as Fuqaha' (sing. Faqih). I am following and learning the method of Hanbali and most of brothers in Saudi Arabia are also following Hanbali methods. My brothers in Malaysia, Yemen, Lower Myanmar, Indonesia, and Southern Thailand are following Shafi'ie methods. My brothers in China and India are following Hanafi and those in Northern Africa in general are following Maliki methods. 

Definitions of Jurisprudence

Fiqh literally means the science of something in order to understand something, common sense in it, and the thought for the honor of the science of law as the quote from the glorious Quran where the God mentioned again what the people of Sho'ayb (Jethro) said to Sho'ayb a.s : "They said, o Sho'ayb! We do not understand many of what you had said and we indeed only see you as a weak person in front of us. If not because of your family, we would have thrown you with stones. And you are not respected for us." (Surah Huud verse 91). And the word understand in the verse signifies anything which lead people to think and ponder.

Terminologically, Fiqh means the science on the rulings of the way of leading life, practices, benefits, based from valid and accurate proofs in accordance to the origin of the fiqh or understanding.  

So, basically when newspapers wanted to tell everyone about this, they should also check the books and sources regarding this from the root source and not just from internet googling or by reading something at the surface. Reporters today are just as ignorant and irresponsible as the mat rempits who illegally racing on the road and later banging young bitchy girls if they won the illegal race. Orientalists, they went to study these too but they were also bias. The same thing also happen to some Muslims who just google up this and that about other system of belief or faith or reading certain blog related to some nonsense conspiracy theories which denies the Wisdom of the God the Most Highest. 

My past experience as a "deviant Muslim" boy for few years in my life had also helped me to understand many things and I found that bashing others are just making people mind restless and later it affects the environment around. These kind of people would put some information in their sites or books and they later including their opinions based from their hatred to others, irrationality, unstable emotion or based from their perception game. Nothing is better than whatever they think because the thing which they prefer will eventually come to their favor. They could not propagate anything without telling that others are less better than them. Later others who had never read root sources and sharing the same hatred would also use the points from that and spread it worldwide. Again, these sick people no matter Muslims or non-Muslims need heart and soul purification. They would also easily being affected by diseases and die early I could assure this because not only glorious Quran talked about people who bite their fingers because of baseless anger but also the teachings that I had followed for some times which was Buddhism : )

Regarding science in religion, Ibnu Khaldun in his book Muqaddima (Introduction) had divided science into two branches :

I. Rational ones which have been generated by human intellect. Another one is revelational which is received through revelation and transmitted to others such as what happened to prophets for example the noble prophet Muhammad s.a.w who had received knowledge through revelation and not from studying it in school and he then transmitted it orally to his companions, contemporary, people around him, and later generations.

II. Excludes the use of intellect as far as its reception, reporting, and transmission are concerned. It relates to injunctions of secondary report, derived from usool or origin, calls it into play one's intellect and ability to exercise analogical reasoning. Fiqh is included in this second category. It is a product of later generations since companions of prophet Muhammad s.a.w do not need its formulation into a new branch of science as the law-submitter or the prophet and messenger of the God was still around with them. They may straight away ask the prophet s.a.w for clarification or looking at how he acts when they are not clear on something.

Sources for Legislation Reference

Many people can understand about British Common Law on how the decisions were derived. Whether from past cases as examples for rulings of court or from the jurists decision like some raping cases in the United States. I do watched American short series but I can't remember all of them. Some scene, I still could remember. 

I also learned legal language which involved the Common Law and Tort Law during our translation and interpretation class where one of our lecturer is a Sikh lawyer whose name is Harpal Singh. Well, many students especially girls love him and he is a single guy in the middle age. For me, he is a generous guy who donated a lot to students in order to make class more lively and interactive. I gave all of the food that I get from his class to my roommate, brother Zaydi simply because his father name is Hussein and I want him to be my imam in prayer services in our room. I think he must thought that I was crazy, hahaha. I was also fasting to calm down my mind at that time but I could not waste the food so I just offer them to my roommate and sometimes if I have vegetarian meals I would also offer them to some Hindu friends neighboring my room. At least my acquaintance and friends are healthy and they could save their money, I would be very happy : ) I treated brother Zaydi badly in the beginning simply because he is a Kelantanese and I was also influenced by bad talks of people around. It has to do with misconception and generalization too that we become racist, no? We never have any contact with majority of certain people that we don't really like so we created some negative image for something that we had never experienced. Just get a life and do beneficial things like enhancing amity among human, environment, and animals instead of spreading hatred just because of differences and misconception...

From what I had also learned in our masjids and school for final exam for the course of Islamic Rulings and Legislation, our sources for rulings and details must be obviously come from :  

1. The Glorious Quran.
2. Sunnah or the prophetic traditions and Orthodox Sunnah Muslim have four major methods.
3. Ijma' (agreement) between jurists and ulamas.
4. Qiyyas or common sense for matters which had never happened during prophetic era like smoking which kills others because of the smoke is harmful for human health and environment or rulings regarding the selling of harmful drugs or cracks. It needs human intellectual consideration and jurists need to think or using their head. It also needs researches and evidences.

The Root of Fiqh

What is the root of Fiqh? It refers to methods which had been implied within the derivation of the development of legal provisions of the way from detailed and discreet proofs. On the other hand, the root of Fiqh which places the root or basic methods to develop jurisdiction and legal provisions according to clear Divine guidance and guidelines. The relevance of Fiqh is for jurists to derive legal provisions and rulings with clear evidence in order to implement the execution of nature laws from it.

While for the root of Fiqh, its motive is to to find clear evidence from where emerged the object of evidence on the legal provisions. And each that had been stated from the agreement and consideration based on common sense which falls under the name (of legal opinion) which includes :

1. Plaudits : It is reversing the jurisdiction of the way for example on the provisions on what had been perceived to face is stronger and reversing the jurists.

2. Sent Interests : The meanings or the matters which are linked to the jurisdiction and developed upon it and causing damage or harmful to human society however yet it is always being discussed. 

3. Known to people : It means legal opinions which is based on customs and norms. Custom or norms which is known to people, whatever had been in the character of speech, verbal, their way of thinking, and whatever is accepted and not accepted by the norms of society being repeated until it is accepted by the jurists and there are also other sources to derive opinion on jurisdiction between trained jurists in addition to whatever had already existed in agreement of jurists and various of considerations whether the past or through any other methods proposed by jurists. Sometimes those in India or Pakistan also seeking Brahmin priests to derive law and the effect is that, we can see people without nose or ears because those priests are using Tharmmasastram and Puranas in the derivation of customary law. Media then capture the pics and showing it to lazy people or those who has no feet to come to talk with real people asking this and that.
